OVERVIEW
Welcome to MARO JEWELRY (“Maro,” “we,” “us,” “our”). We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify. These Terms of Service (the “Terms”) govern your access to and use of the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
1. ACCESS, ACCOUNTS & ELIGIBILITY
By using the Services, you represent you are at least 18 (or the age of majority in your jurisdiction) and have capacity to enter into these Terms, and you consent to receive electronic communications from us. You may be asked to provide information (e.g., email, billing, payment, shipping). You represent it is accurate, current, and complete and that you have the right to provide it. You are responsible for safeguarding your credentials and for all activity under your account. You may not assign, sell, or transfer your account.
2. PRODUCTS & AVAILABILITY
We attempt to display products accurately; however, colors/appearance may vary due to device settings. We do not warrant that product appearance or quality will meet expectations. Descriptions, pricing, and availability may change at any time. We may limit quantities or discontinue items.
3. ORDERS & FRAUD SCREENING
Your order is an offer to purchase. We may accept or reject any order, and acceptance occurs when we send an order confirmation after successful payment processing. We may cancel or limit orders that, in our sole judgment, appear to be placed by dealers, resellers, distributors, or are fraudulent/suspicious (including mismatched billing data, unusual quantities, or failed verifications). If we modify or cancel, we will attempt to contact you via the email/billing/phone provided. Your purchases are for personal/household use only. Returns and exchanges are governed by our Refund Policy. Promo codes are single-use unless stated, non-transferable, not redeemable for cash, and may be withdrawn at any time.
4. PRICES, TAXES & BILLING
Prices, promotions, and discounts may change without notice. The price charged is the price at checkout and on your confirmation email. Taxes, shipping, handling, customs, and import duties (if any) are your responsibility unless stated otherwise. By submitting payment, you represent you are authorized to use the payment method and agree to pay all charges. We reserve the right to correct manifest pricing errors and to cancel/refund affected orders.
5. SHIPPING, DELIVERY & RISK OF LOSS
Delivery times are estimates only, not guarantees. We are not responsible for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when we hand the package to the carrier.
Puerto Rico: deliveries may involve different taxes/fees or transit times under local regulations and carrier policies. Any such costs are the customer’s responsibility unless we expressly state otherwise at checkout.
6. INTELLECTUAL PROPERTY
All content on the Services (including trademarks, logos, text, images, graphics, video, audio, selection and arrangement) is owned by Maro, our affiliates, or licensors and protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No rights are granted except as expressly set out in these Terms.
7. OPTIONAL TOOLS & THIRD-PARTY LINKS
We may provide access to third-party tools “as is” without warranties. Your use is at your own risk and subject to the third party’s terms. The Services may link to third-party sites. We are not responsible for their content, policies, or practices.
8. RELATIONSHIP WITH SHOPIFY
Maro is powered by Shopify; however, all sales are with Maro. Shopify is not responsible for sales, products, or claims arising from your transactions with us. You release Shopify and its affiliates from any related claims.
9. PRIVACY
Personal information is handled per our Privacy Policy and Shopify’s privacy terms. Because we are hosted on Shopify, information about your use of the Services may be processed by Shopify and service providers in other countries.
10. USER CONTENT & REVIEWS
If you submit reviews, photos, comments, or other content (“User Content”), you grant Maro a worldwide, perpetual, irrevocable, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, create derivative works, and display such User Content in any media for operating, improving, and promoting the Services. You represent you own or control the rights to your User Content; it is accurate and lawful; you have disclosed any incentives; it does not contain viruses, illegal, or abusive material; and it does not infringe others’ rights. We may moderate or remove User Content at our discretion.
11. ELECTRONIC COMMUNICATIONS; SMS/WHATSAPP/DM MARKETING
By using the Services or contacting us, you consent to receive electronic communications (emails, on-site notices). If you opt in to SMS/WhatsApp/Instagram DM marketing, you agree to receive recurring automated marketing messages at the number/account provided. Consent is not a condition of purchase. Message and data rates may apply. You can opt out at any time (e.g., reply STOP).
12. ERRORS & OMISSIONS
Information on the Services may contain typographical errors or inaccuracies (including pricing, availability, shipping charges, transit times). We reserve the right to correct and update information or cancel orders if information is inaccurate, at any time without prior notice.
13. PROHIBITED CONDUCT
You may not use the Services for unlawful purposes; violate laws; infringe IP; harass or harm others; transmit false/misleading information; upload malware; spam; scrape; bypass security; or interfere with operation. We may suspend or terminate access for violations.
14. EXPORT CONTROLS & SANCTIONS
You represent that you are not located in, under control of, or a national/resident of any country or entity subject to U.S. embargoes or sanctions, and that you will not use the Services in violation of export control laws.
15. ACCESSIBILITY

16. FORCE MAJEURE
We are not liable for any failure or delay due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor conditions, power outages, internet failures, carrier delays, or government actions.

Except as expressly stated, the Services and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free. Some jurisdictions do not allow certain disclaimers; those disclaimers apply to the maximum extent permitted by law.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Maro, Shopify, and our respective affiliates, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of your use of the Services or products, even if advised of the possibility. Our aggregate liability will not exceed the amount you paid for the product giving rise to the claim.
19. INDEMNIFICATION
You agree to indemnify and hold harmless Maro, Shopify, and our affiliates, officers, employees, and agents from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or misuse of the Services.
20. TERMINATION
We may terminate or suspend access to the Services at any time. Sections that by nature should survive termination will survive (including IP, User Content, Disclaimers, Liability limits, Indemnity, Governing Law).
21. GOVERNING LAW & DISPUTE RESOLUTION
These Terms and any disputes are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in the City of New York, New York.

Headings are for convenience only and do not affect interpretation.
23. CHANGES TO TERMS
You can review the most current version of these Terms at any time on this page. We may update these Terms by posting a revised version with a new “Last updated” date. For material changes, we will provide notice as required by law (e.g., by email or site notice). Your continued use after changes become effective constitutes acceptance.
